An appellate court is not entitled to alter a trial judge's apportionment of contributory negligence merely because the court would have reached a different decision; the apportionment must stand unless there is discernible error and it was not reasonably open. In apportioning liability, a trial judge may attribute particular significance to the speed of the defendant's vehicle in relation to both the inability to avoid the collision and the severity of the plaintiff's injuries.
