A head contractor who subcontracts construction work to an independent contractor remains 'the person in charge of the construction work' for the purposes of Regulation 74 of the Construction Safety Regulations 1950, and is obliged to provide safety equipment (safety belts, harnesses, lines, or nets) for workers on the site, notwithstanding that the High Court's decision in Buckman v Flanagan holds that Regulation 73 does not impose obligations on persons who subcontract work to independent contractors. The roof of a factory building is not within the definition of 'factory' for the purposes of s 40 of the Factories, Shops and Industries Act 1962.
