Under cl 149 of the Poisons and Therapeutic Goods Regulations 1994 (NSW), the Director-General's power to suspend or cancel a methadone supply licence must be exercised if one or more of the specified grounds is established; the word 'may' is directed to the manner of exercise (suspension or cancellation) rather than conferring a discretion whether to act. An appeal to the District Court under cl 152 is a hearing de novo subject to the rules of evidence, including the Evidence Act 1995 (NSW). Evidence of complaints made to witnesses about amenity disruption is admissible as relevant to those witnesses' perceptions of amenity, and once admitted for that purpose is admissible for all purposes under s 60 of the Evidence Act.
