Where a trial judge grants a stay on Dietrich grounds (indigency and unfairness of proceeding without representation), but rejects an abuse of process argument that the prosecution is doomed to failure, the appropriate order is an interim stay (until representation is obtained) rather than a permanent stay. A permanent stay in such circumstances is outside the legitimate exercise of discretion.
