A Jones v Dunkel direction against an accused concerning the failure to call witnesses who are alleged accomplices is likely to be erroneous and to occasion a miscarriage of justice, particularly where the Crown bears the onus of proof and the witnesses are criminally complicit on the Crown case. The proviso to s 6 of the Criminal Appeal Act 1912 is not appropriate where such a direction might seriously undermine the onus on the Crown.
