Where an offender's possession of a prohibited drug is partly for personal use and partly for supply, the sentencing judge must make findings as to the amounts actually supplied on each count; the deemed supply provision in s 29 does not operate to make all drugs found in possession deemed for supply. The proposition that drug supply offences committed to finance the offender's own addiction are on a 'lower level' of criminality is doubted following R v Henry; the relevance of addiction is confined to explaining why quantities were small and to assessing prospects of rehabilitation.
