Where a prisoner's medical condition deteriorates dramatically after sentencing to a degree not anticipated at the time of sentence, the Court of Criminal Appeal may receive fresh evidence and intervene where the condition makes imprisonment significantly more burdensome than anticipated and undermines the sentencing judge's assessment of recidivism risk. The motivation of committing offences to pay a drug debt does not differ in kind from committing crime to feed an addiction for the purposes of mitigation.
