The existence of factors capable of supporting a finding of special circumstances under s 5(2) of the Sentencing Act 1989 does not compel such a finding; the sentencing judge retains a discretion, and the appellate court will not intervene merely because it might have been open to find special circumstances. Depression arising from drug withdrawal, while relevant, does not compel a finding of special circumstances where treatment is available within the prison system.
