An order striking out an action for failure to comply with a security for costs order is interlocutory, not final, and leave to appeal is required under s 118(3) of the District Court Act 1968 (Qld). Striking out for non-compliance with security for costs is treated as a form of dismissal for want of prosecution. To set aside an interlocutory security for costs order, a party must demonstrate additional relevant facts that have arisen or been discovered since the order was made; allegations of fraud concerning the underlying dispute do not constitute such additional relevant facts.
