A suspended sentence cannot be imposed concurrently with probation or community service under the Queensland adult sentencing regime, following R v Hughes. Where such an impermissible combination is imposed, the appellate court may extend the community-based orders to cover all counts rather than substitute a custodial sentence, particularly where practical constraints prevent increasing the penalty on appeal. Graffiti offences involving significant damage warrant strongly deterrent sentences, and an intensive correction order is an appropriate sentencing option for serious offending by young offenders.
