The appropriate sentencing range for the rape of a stranger in her own home involving considerable violence is 10 to 14 years' imprisonment. The 1997 amendments to the Penalties and Sentences Act 1992 (Qld), which removed the ability to make parole recommendations for sentences of 10 years or more for rape, do not alter the applicable sentencing range established by pre-amendment authorities such as Coghlan and Grienke.
