Section 92(5) of the Penalties and Sentences Act 1992 (Qld) prohibits the suspension of any term of imprisonment imposed on the same sentencing occasion as a probation order, even where the suspended sentence and probation order relate to different offences. When remedying such invalid sentences on appeal, the court must not increase the effective severity of the overall sentencing burden, in accordance with Neal v The Queen.
