Evidence of prior criminal charges laid against an accused (particularly where those charges did not result in convictions) is irrelevant and should not be admitted through cross-examination of a defence witness where the prejudicial effect of disclosing the charges to the jury outweighs the probative value of the evidence for credibility purposes. The fact that charges did not result in convictions is an even stronger reason for exclusion than the existence of convictions subject to appeal.
