The Queensland Court of Appeal held that the trial judge's assessment of damages for past economic loss, future economic loss, and pain, suffering and loss of amenities of life was manifestly excessive and beyond the limits of a sound discretionary judgment. The Court substituted reduced awards of $25,000 for pain and suffering and loss of amenities (with no interest) and $55,000 for past and future economic loss, reducing the total award to $109,539.72. The majority (Pincus JA and White J) found the trial judge had applied an incorrect test in assessing economic loss, with McMurdo P dissenting in part.
