A charge of conspiracy to traffick in a drug of dependence may be laid under s.321(1) of the Crimes Act 1958 (Vic) rather than s.79 of the DPCS Act 1981 (Vic). The two provisions create different but overlapping offences and are not inconsistent. Division 10 of the Crimes Act expressly contemplates and accommodates conspiracy provisions in other statutes. The DPCS Act does not cover the field in relation to drug offences.
