Section 5(1A)(b) of the Limitation of Actions Act 1958 (Vic) requires only that the plaintiff know that the personal injuries were caused by the act or omission of some person; it does not require knowledge that the act or omission was wrongful or negligent. The decisions in Perry v Royal Women's Hospital and Donnelly v State of Victoria are no longer good law on this point. The question whether 'disease or disorder contracted' in s.5(1A) is confined to insidious diseases or extends to traumatic injuries was left open but the Court signalled doubt about the broad interpretation adopted in earlier cases.
