A person who hands a forged document to a tipstaff or other court officer in the course of proceedings, in circumstances where its objective purpose is to influence the judge, 'produces' that document to the judge for the purposes of a charge of attempting to pervert the course of justice; physical handing to the judge is not required. The tendency to pervert the course of justice in a forged document inheres in the forgery itself, not in the document's contents, and is not exhausted merely because the contents have been read aloud. A sentencing judge who fails to properly account for a psychiatric disorder existing at the time of offending, particularly in relation to the application of general deterrence, commits sentencing error.
