Rule 23.03 requires the defendant to establish a good defence on the merits and cannot be used merely on the basis that the statement of claim does not disclose a cause of action — that is the province of Rule 23.01. Where a self-represented plaintiff's claim depends on a document that cannot bear the construction alleged, and the plaintiff concedes no other foundation exists, the claim may be stayed as frivolous and vexatious under Rule 23.01. Orders preventing a party from filing further applications should be rare and made only after careful consideration, and may be beyond power if they extend to preventing new proceedings.
