A conviction for assault under s 222 of the Criminal Code (WA) requires proof that the assailant had an intention either to use force or to create an apprehension of the use of force. Evidence that is equally consistent with self-defence as with an intention to threaten is insufficient. A Magistrate must articulate in reasons how the essential elements of the offence were proven, including the element of intention.
