In complex construction cases, a trial judge may decline to strike out a deficient statement of claim where the judge intends to have the issues defined through a process of conferral and issue identification rather than by the pleadings alone. Schedules to a statement of claim may properly contain material that might otherwise be required in the body of the pleading, particularly in construction cases involving factual complexity.
