A sentence of 12 months' imprisonment for social security fraud involving approximately $12,000 over 34 fortnights is not manifestly excessive, but a recognisance release order under s 21B of the Crimes Act 1914 (Cth) should be considered where the offender has no significant prior dishonesty record, pleaded guilty, has dependants, has continuing employment, and is making restitution. Repayment of fraudulently obtained money is not a mitigating circumstance but the financial effect on dependants is a relevant factor under s 16 of the Crimes Act 1914 (Cth).
