An absolute assignment of a chose in action under s 20 of the Property Law Act 1969 (WA), perfected by written notice, divests the assignor of all right, title and interest, rendering the assignor unable to maintain proceedings. Where a company in liquidation assigns the subject matter of an appeal, the appeal will be stayed pending joinder of the assignee as appellant. A liquidator's power under s 477(2)(c) of the Corporations Law to 'sell or otherwise dispose of' company property extends to assignment of choses in action.
