In social security fraud cases, even where the offender has breached a prior recognisance and deterrence must loom large, the sentencing court must still consider rehabilitation and the offender's personal circumstances. A fully-served custodial sentence is not the only means of achieving deterrence; an immediate sentence followed by release on recognisance can serve both personal and general deterrence. For fraud of approximately $4,280 with significant personal mitigating circumstances, a sentence of 12 months with release after 4 months on recognisance was appropriate.
