Commission of serious offences while on parole, combined with poor performance on community supervision and absence of positive rehabilitative factors, provides a sufficient basis for a sentencing judge to decline to make a parole order without the discretion miscarrying. There must be some prospect of benefit to the offender or the community to trigger the discretion to grant parole.
