There is no general duty of disclosure owed by an applicant for a search warrant to the issuing officer, and no analogy with ex parte equitable relief principles. Section 3F(5) of the Crimes Act 1914 (Cth) authorises AFP to transfer possession of seized documents to another agency where necessary for investigating offences. Section 3L(2)(c) authorises copying the entire contents of a storage device (not merely evidential material) once evidential material is found on it. The onus of establishing improper purpose in the issue of search warrants lies on the party challenging the warrants, and the existence of concurrent civil and criminal investigations does not of itself establish improper purpose.
