Section 54(1) of the Migration Act requires the Minister to give realistic and genuine consideration to information in a visa application through an active intellectual process, but does not require the Minister to treat every piece of information as a fundamental element in the decision-making process. The extent of the required intellectual process depends on the nature of the information and its degree of relevance. The 28-day time limit in s 478 of the Migration Act does not prevent the Federal Court from hearing a matter remitted from the High Court under s 44 of the Judiciary Act.
