A claim for 'special value' under s 57 of the Land Acquisition (Just Terms Compensation) Act 1991 cannot be sustained on the basis that the dispossessed owner would pay a higher rent to retain the land rather than lose it — such reasoning is circular. Special value requires an objectively ascertainable financial advantage incidental to the owner's use of the land. In the field of judicial valuations, it is permissible to apply alternative valuation formulae and adopt a composite figure, and not every step need be separately justified.
