Where a motor vehicle is merely used as a means of access to a worksite (such as a cherrypicker elevating workers to power lines), the employer's fault in failing to provide a safe system of work does not constitute fault 'in the use or operation of the vehicle' for the purposes of compulsory third party insurance. The critical distinction is between fault that occurs while a vehicle is being used and fault that is in the use of the vehicle itself.
