An entrepreneur who engages independent contractors to perform building work at height, where there is a need for coordination and direction and a risk of injury, owes a duty to prescribe and provide a safe system of work, including protection from falling. An occupier who engages an apparently competent independent contractor to manage building works discharges its duty of care by the act of engaging that competent contractor.
