An application under s 30A of the Proceeds of Crime Act 1987 (Cth) to extend the waiting period under s 30 may be determined after the six-month waiting period has expired, provided the application was filed within the waiting period and diligently prosecuted. The power to extend subsists until the application is determined. It is not necessary to invoke inherent jurisdiction to make orders nunc pro tunc where the statute, properly construed, authorises the order.
