The question of double insurance for the purposes of contribution between co-insurers must be determined at the date of the casualty, not at the time the contribution claim is made. An injured party's choice to sue only one of multiple potential defendants (e.g., the negligent driver rather than the vicariously liable employer) does not defeat the right of contribution between co-insurers who both covered the employer's liability at the time of the accident. The equitable right of contribution cannot be defeated by a 'second layer of choice' exercised by a third party.
