Where a plaintiff's own evidence establishes that they would have entered a different transaction rather than no transaction at all, the case will be treated as a 'different transaction' case regardless of how it is pleaded. The plaintiff bears the burden of leading evidence as to what the different transaction would have been and quantifying the difference in position. Failure to lead such evidence is fatal to the claim for damages.
