Whether an object is part of a vehicle for the purposes of the Motor Accidents Act 1988 (NSW) is a question of fact and degree, determined by whether the object is so taken up within the vehicle that it becomes an integral part of it, with the purpose of the object and the means of its attachment being of paramount importance. Objects not made or installed by the vehicle manufacturer may still be part of the vehicle. The Act applies to injuries sustained during loading and offloading operations, not merely to injuries arising from the use of a vehicle as transport.
