Where a jury's award of general damages is conceded to be excessive and credibility is central to the assessment, the Court of Appeal cannot reassess under s 107 of the Supreme Court Act 1970 (NSW) and must order a new trial. Where the excessive award raises a real possibility that the error affected other heads of damages, the new trial should not be limited to general damages alone but should extend to all heads of damages.
