The 'land' on which an existing use is carried out for the purposes of cl 42(2)(b) of the EPA Regulation 2000 is determined by the facts and circumstances of the particular existing use, not by title boundaries or the physical extent of the building. Where development consent was granted for a use on one floor of a multi-storey building, the 'land' is limited to that floor, and the use cannot be expanded to other floors unless those areas were held in reserve for the existing use. Ancillary areas such as car parks and staircases required by conditions of consent do not expand the 'land' for existing use purposes.
