The Federal Courts (State Jurisdiction) Act 1999 (NSW) creates its own rights, liabilities, obligations and status by reference to ineffective Federal Court judgments, regardless of whether those judgments have been set aside. Proceedings commenced by a liquidator appointed under an ineffective Federal Court winding-up order may continue in the Supreme Court on the basis of rights conferred by the State Jurisdiction Act. The High Court's prohibition in Re Brown; Ex parte Amann was limited to preventing further steps in the Federal Court and does not prevent proceedings in State courts.
