A later offer of compromise supersedes an earlier one for the purpose of determining entitlement to indemnity or solicitor and client costs. Where a plaintiff's judgment exceeds a pre-trial offer of compromise but does not exceed a subsequent pre-appeal offer, the plaintiff is entitled to solicitor and client costs of the trial from the date of the pre-trial offer but not indemnity costs of the appeal.
