Answers given to questions asked in relation to an indictable offence during official questioning 'relate to' that offence within the meaning of s 424A(4)(c) of the Crimes Act 1900, even where the answers are sought to be tendered in proceedings for a summary offence. The words 'relates to' are to be construed liberally. The unavailability of recording equipment because it is being used for another interview does not constitute a 'reasonable excuse' under s 424A(2) where the questioning could have been delayed. Smart AJ's dissenting view — that s 424A does not prevent reception of admissions about summary offences in summary proceedings — was not adopted by the majority.
