For sentencing under s 25A of the Drug Misuse and Trafficking Act 1985, the quantity of drugs supplied is a relevant but not determinative consideration; the magnitude of the dealing operation and the deterrent purpose of the legislation must also be taken into account. An appropriate differentiation in sentencing can be drawn between bigger, more organised dealers (sentences towards the upper end) and street-level dealers at the bottom of the distribution chain. Where a sentencing judge makes errors both adverse and favourable to the offender, the appeal court may find the errors counter-balance each other such that no lesser sentence is warranted.
