Fresh evidence from a credible witness who was present at the scene and could positively exclude the accused as a perpetrator, where the conviction rested solely on identification evidence, meets even the more stringent Mickelberg test for setting aside a conviction. Where a trial judge recalls the Crown's submission that multiple identification witnesses reduce the possibility of error, the judge should emphasise that two or more witnesses may be in error for similar reasons.
