The Wilson v The Queen test requiring foresight of an appreciable risk of serious injury applies to manslaughter liability of a participant in an extended joint criminal enterprise; a lower standard of foresight of 'more than trivial harm' is insufficient. The question whether this test is to be applied objectively or subjectively in the extended joint enterprise context was expressly left open.
