The Jurisic sentencing guidelines for dangerous driving offences causing grievous bodily harm do not mandate full-time custody in every case; they expressly contemplate exceptional cases warranting departure. Where the victim is the offender's spouse who is wholly dependent on the offender for care, and imprisonment would cause extraordinary hardship to the victim, a suspended sentence may be appropriate notwithstanding the seriousness of the offence. An offender's years of dedicated care for the victim may be taken into account as effective punishment.
