When assessing the discount for an offender's offer to give evidence for the prosecution under s 23 of the Crimes (Sentencing Procedure) Act 1999, the sentencing court must consider the probable impact of the evidence on offer — whether it is the sole evidence or merely corroborative — but cannot disparage the offer on the basis that the prosecution might not use the evidence or that it might not lead to a conviction, where the offer appears genuine. The onus of proving the extent and value of assistance remains on the offender.
