Offences committed in Commonwealth places (airports, defence establishments, etc.) under State laws applied by the Commonwealth Places (Application of Laws) Act 1970 (Cth) are Commonwealth offences, but State police retain powers of arrest and search and the State DPP retains standing to prosecute under the cooperative scheme established by s6(2) of the Act and the relevant Arrangement. There is a strong presumption against implied repeal of statutes forming part of collaborative national schemes. No s109 inconsistency arises between an applied State law and a Commonwealth law because the applied provision operates as Commonwealth law.
