Where a sentencing judge has applied sentencing guidelines subsequently overruled by the High Court (here, Wong & Leung), the Court of Criminal Appeal will grant leave to appeal against sentence but will dismiss the appeal if, on independent assessment of all relevant considerations, the sentence imposed is the proper sentence. The detection of error in the reasoning process does not require or empower the appellate court to interfere with the sentence unless it is of the view that a different sentence should have been passed.
