In a sexual assault trial where consent is the sole issue and the complainant gives evidence of absence of consent, a Weissensteiner direction regarding the accused's failure to give evidence is not appropriate. Such a case is not an exceptional case where evidence could only come from the accused, as required by RPS v The Queen. The proviso will not cure such a misdirection where it goes to the heart of the critical issue at trial.
