Section 588FF(3) of the Corporations Law authorises the Court to make general orders extending the time for voidable transaction proceedings, not limited to particular transactions or persons. However, where liquidators have specifically identified potential defendants and had substantial correspondence with them about preference claims, those persons have a legitimate expectation of being notified and heard before an extension order is made. An opportunity to apply to set aside ex parte orders after they are made is not necessarily sufficient to satisfy procedural fairness in such circumstances.
