Disparity between an adult offender's custodial sentence and a juvenile co-offender's non-custodial sentence does not constitute impermissible parity error where the difference is explained by the distinct sentencing regimes under the Juvenile Justice Act 1992 (Qld) and the Penalties and Sentences Act 1992 (Qld). A sentencing judge is not required to 'even up' sentences imposed under different regimes. Youth no longer possesses the same mitigating weight it had before 1977.
