The Court of Appeal held that valuers whose valuations determined the price under a contract to which they were not parties owed a duty of care to the contracting parties, and could be held liable in negligence for economic loss flowing from negligent valuations. The appeal against the trial judge's findings on liability, contributory negligence, quantum of damages, and interest was dismissed on all grounds. The Court considered but rejected arguments that the damages were excessive and that the trial judge erred in the assessment of interest under s 47 of the Supreme Court Act 1995 (Qld).
