The Queensland Court of Appeal dismissed the appeal against conviction, holding that the trial judge's direction to the jury on the use of the accused's lies as evidence of consciousness of guilt was adequate. The Court applied Edwards v R and Zoneff v R in assessing whether the lies direction sufficiently particularised the relevant lies and whether any deficiency in the direction resulted in a substantial miscarriage of justice under s 668E(1A) of the Criminal Code (Qld). The Court also considered whether lies could properly be used as evidence of consciousness of guilt of murder as distinct from manslaughter.
